Agreement to these terms

These terms of service (“terms”) apply when you use our website or buy from us. By using the site or placing an order, you agree to them. If you don’t agree, please don’t use the site.

Our Shipping & returns policy forms part of these terms. Our Privacy policy explains how we handle personal information.

About us

This website, https://primeclothing.online, is run by Prime Clothing (“we”, “us”, “our”). You can reach us at support@primeclothing.online or through our contact page.

Eligibility

To place an order you must be at least 18 years old, or be using the site with the involvement of a parent or guardian who agrees to these terms on your behalf.

You must give accurate, complete and current information when you check out or create an account.

Products

We describe and photograph our products as accurately as we can, but:

• colours on screen depend on your display, so an item may look slightly different in person;
• the measurements in our size guides are approximate, and individual garments can vary slightly;
• product photos are representative of the item — the piece you receive may differ in small ways from the one pictured.

Each product page lists what the item is made of and how to care for it. Follow the care instructions to keep it in good condition.

Prices and availability

Prices are shown and charged in US dollars (USD). If you pay with a card in another currency, your bank or card issuer sets the exchange rate and may charge a fee. Shipping costs and any applicable taxes are shown at checkout before you pay.

We may change prices at any time. A change won’t affect an order you’ve already placed, except as described below.

Pricing errors. Mistakes occasionally happen. If an item is listed at an incorrect price, we may cancel the order and refund you in full, even after you’ve received an order confirmation.

Availability. All products are subject to availability, and listing an item on the site doesn’t guarantee it’s in stock. If we can’t supply all or part of your order, we’ll tell you and refund anything we can’t send.

Orders

When you place an order, you’re offering to buy the items in it. The order confirmation page confirms that we’ve received your order and, once online payments are switched on, your payment. It doesn’t mean we’ve accepted the order yet.

A contract between you and us is formed when we dispatch your order.

We may refuse or cancel any order before dispatch — for example, if an item is unavailable, there’s an error in the price or description, we suspect fraud or unauthorised use of a payment method, or we can’t deliver to your address. If we cancel an order you’ve paid for, we’ll refund you in full.

Payment

Online payments aren’t switched on yet. Until they are, checkout places test orders only: nothing is charged and nothing ships.

When online payments are switched on, card payments will be processed by Stripe, Inc. Your card details go directly to Stripe; we never see or store your full card number. Your payment will be taken when you place your order, and Stripe handles your payment details under its own privacy policy.

Promo codes

• One promo code can be used per order.
• Codes discount the price of items, not shipping or taxes.
• Codes have no cash value and can’t be exchanged for cash or credit.
• A code can’t be applied to an order after it has been placed.
• We may change or end a code at any time, and may cancel an order that uses a code in breach of its conditions.

Shipping, title and risk

We ship to the countries listed on our Shipping & returns page, at the rates and estimated delivery times shown there. Delivery times are estimates, not guarantees.

Ownership of the items (“title”) and the risk of loss or damage pass to you when the items are delivered to the shipping address you gave us.

International orders

If you order for delivery outside the United States, your country may charge import duties, taxes and customs fees. These aren’t included in our prices or shipping charges, and they’re your responsibility. You’re also responsible for making sure the items can lawfully be imported into your country.

Returns and refunds

You can return eligible items within 30 days of delivery. Our Shipping & returns policy explains the conditions, how to start a return and how refunds work.

Nothing in these terms affects your statutory rights, including any right to cancel an order or to a remedy for faulty goods under the law where you live.

Your account

Accounts on this site are saved in your browser on your device, not on our servers. That means:

• you can only sign in from the browser where you created the account;
• we can’t see, recover or reset your password — if you forget it, you can remove the saved account and create it again;
• clearing this site’s data from your browser deletes the account.

You’re responsible for keeping your device and password secure, and for activity on your account on your device. Sign out when you use a shared computer.

Acceptable use

When you use the site, you agree not to:

• use it for anything unlawful, fraudulent or harmful;
• place orders with payment details you aren’t authorised to use;
• try to interfere with the site, its security or anyone else’s use of it, including by introducing malicious code;
• copy or collect content from the site in bulk, by automated means or otherwise, without our permission.

Intellectual property

The text, photographs, graphics, logo and design of this site belong to us or the people who license them to us, and are protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce or use them for any other purpose without our written permission.

Third-party services

We rely on other companies to run the site and, once online payments are switched on, to take payment: Stripe (card payments), our hosting provider (the server this site runs on) and, when it’s switched on, a form service such as Formspree that delivers contact messages and order details to us. Their own terms and privacy statements apply when you use their services.

We aren’t responsible for the content or practices of other websites we link to.

Disclaimers

To the extent permitted by law, the site and its content are provided “as is” and “as available”. We don’t promise that the site will always be available, uninterrupted or free of errors.

Our products come with the guarantees and warranties that the law gives you. Apart from those, and to the extent permitted by law, we make no other warranties, express or implied. This doesn’t affect any rights you have under consumer law that can’t be excluded.

Limitation of liability

To the extent permitted by law:

• we aren’t liable for indirect or consequential losses — such as loss of profit, data or opportunity — arising from your use of the site or our products;
• our total liability to you for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these terms limits or excludes liability that can’t be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence.

Indemnity

If you breach these terms or misuse the site — for example, through fraud or by attacking the site — and that leads to a claim against us by someone else, you agree to cover our reasonable losses and costs arising from that claim, to the extent the law allows.

Governing law and disputes

These terms are governed by the laws of the United States and the state in which Prime Clothing is registered, without regard to conflict-of-law rules.

If something goes wrong, please contact us first — most problems can be sorted out quickly by email. If we can’t resolve it together, disputes may be brought before the courts that have jurisdiction under that law.

If you’re a consumer, nothing in these terms takes away the protection of the mandatory consumer laws of the country or state where you live, or any right you have to bring a claim in your local courts.

Severability and general terms

If any part of these terms is found to be invalid or unenforceable, the rest stays in effect. If we don’t enforce a term straight away, we can still enforce it later.

These terms, together with our Shipping & returns policy and Privacy policy, are the whole agreement between you and us about your use of the site and your orders.

Changes to these terms

We may update these terms from time to time — for example, when the law changes or we change how the shop works. The terms on this page when you place an order apply to that order. The date at the top of this page shows when they last changed.
